1. Parties and Company Information

These Terms take effect between the following parties:

Evrenix is the content provider of the Site within the meaning of Turkish Law No. 5651 on the Regulation of Publications on the Internet, and the identifying information above is provided pursuant to Article 3 of that Law and Article 39 of the Turkish Commercial Code No. 6102.

2. Scope of Services

The Site is operated to provide information about Evrenix's SAP SuccessFactors consulting, custom software development, process automation and SaaS products, and to receive contact requests.

The content on the Site is for general information purposes only, and nothing on the Site constitutes a binding offer. Consulting, software development and related professional services are provided under separate written service agreements to be concluded between the parties, which define their scope, fees and conditions. Submitting a request through the contact form does not create a contractual relationship between the parties.

No orders are taken and no payments are accepted through the Site; it is operated to present Evrenix's services and products and to receive contact requests. Accordingly, the legislation on distance contracts does not apply to use of the Site. These Terms will be updated if online contracting is made available through the Site.

Subscriptions to Evrenix's SaaS product Hiring Rumble are sold through https://hiringrumble.com. Those sales are governed by the Distance Sales Agreement (https://hiringrumble.com/mesafeli-satis-sozlesmesi), the Pre-Information Form (https://hiringrumble.com/on-bilgilendirme-formu) and the Cancellation and Refund Policy (https://hiringrumble.com/iptal-iade) published on that site. These Terms do not govern the subscription relationship formed there.

3. Acceptable Use

The User agrees to comply with applicable law and these Terms when using the Site. The following are prohibited:

• Any interference intended to disrupt the operation of the Site, place excessive load on it, or circumvent its security measures;
• Uploading or transmitting malware, viruses or other malicious code to the Site;
• Submitting unlawful, misleading, defamatory content, or content that infringes third-party rights, through the contact form;
• Collecting or reproducing Site content without permission by automated means (bots, scrapers, etc.);
• Copying, reproducing or distributing the Site or its content for commercial purposes without Evrenix's prior written consent.

4. Intellectual Property

All intellectual and industrial property rights in the Site and its content (including but not limited to texts, images, logos, trademarks and designs, software and source code) belong to Evrenix or its licensors and are protected under applicable law, including the Turkish Law No. 5846 on Intellectual and Artistic Works and the Turkish Industrial Property Law No. 6769. This content may not be copied, reproduced, distributed, adapted or used for commercial purposes without Evrenix's prior written consent. Personal, non-commercial viewing is permitted.

5. Third-Party Links

The Site may contain links to third-party websites (for example, hiringrumble.com). The relevant third parties are responsible for the content, privacy practices and terms of use of linked sites; Evrenix has no control over those sites and cannot be held liable for them.

6. Limitation of Liability

The Site and its content are provided "as is". Evrenix does not warrant that the Site will operate uninterrupted, error-free or entirely free of security vulnerabilities; it exercises reasonable care regarding the currency and accuracy of the information on the Site but gives no express or implied warranty in this respect.

Except in cases of wilful misconduct or gross negligence, Evrenix shall not be liable for indirect, incidental or consequential damages (including loss of profit, loss of data or loss of business) arising from the use of, or inability to use, the Site. Pursuant to Article 115 of the Turkish Code of Obligations No. 6098, liability arising from wilful misconduct or gross negligence cannot be excluded in advance; such liability, and any other liability that cannot be limited under mandatory provisions of applicable law, falls outside the limitations in this section. The statutory rights of users qualifying as consumers remain reserved.

7. Personal Data Protection

Detailed information on the processing of personal data collected through the Site is available in the Privacy Policy & Notice and the Cookie Policy published on the Site. Non-essential cookie and analytics technologies run only according to the choice you make through the cookie consent mechanism on the Site; you can change your preferences at any time via the "Cookie Preferences" link at the bottom of the page. Those documents form an integral part of these Terms.

8. Changes to the Terms

Evrenix reserves the right to update these Terms at any time. Updated Terms take effect on the date they are published on the Site. Continued use of the Site constitutes acceptance of the current Terms.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The Istanbul Anatolian (İstanbul Anadolu) Courts and Enforcement Offices have jurisdiction over any dispute arising out of or in connection with these Terms. For users qualifying as consumers, mandatory provisions regarding the competence and jurisdiction of consumer arbitration committees and consumer courts remain reserved.

10. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the validity of the remaining provisions shall not be affected. Evrenix's failure or delay in exercising any right under these Terms shall not constitute a waiver of that right.
